Terms of Service of the Libriya Platform

These Terms of Service govern the use of the Libriya platform, available at: libriya.app

1. General Provisions

The Libriya platform ("Platform") is provided by Marcin Sachs, conducting unregistered business activity ("Service Provider"). Using the Platform constitutes acceptance of these Terms of Service.

2. Definitions

  • Platform – the Libriya web service available at libriya.app, enabling library collection management.
  • User – any person using the Platform, including Library Administrators and Readers.
  • Library Administrator – a User who manages a library within the Platform.
  • Reader – a User accessing library resources through the Platform.
  • Account – an individual User account enabling access to the Platform.
  • Premium Plan – a paid subscription plan extending Platform functionality.

3. Registration and User Account

Full use of the Platform requires creating an Account. Registration is voluntary and free of charge for the basic plan.

The User is required to provide accurate information during registration and to update it if it changes. An Account is personal and may not be shared with third parties.

The User is responsible for all actions taken through their Account. If unauthorised access to the Account is suspected, the User should immediately notify the Service Provider.

4. Rules of Use

The User agrees to use the Platform in accordance with its purpose, applicable law, and these Terms of Service. In particular, it is prohibited to:

  • post content infringing the rights of third parties, including copyright,
  • take actions that disrupt the operation of the Platform or pose a threat to its security,
  • use the Platform to send spam or unsolicited messages,
  • provide false information or impersonate other persons,
  • attempt to reverse engineer or gain unauthorised access to the system.

5. Premium Plan

The Platform offers a paid Premium Plan that extends the available functionality. Detailed information about pricing and the scope of the Premium Plan is available on the Platform.

Premium Plan fees are charged according to the billing cycle selected by the User. The Service Provider reserves the right to change the pricing, notifying Users with reasonable advance notice.

6. Intellectual Property

All rights to the Platform, including copyright to the code, graphics, logos, and other elements, belong to the Service Provider or entities from which the Service Provider has obtained appropriate licences.

The User is granted a non-exclusive and non-transferable right to use the Platform in accordance with these Terms of Service. Any other use of Platform content requires the written consent of the Service Provider.

7. Liability

The Service Provider will make every effort to ensure the Platform operates continuously and reliably, but is not liable for interruptions resulting from technical reasons, maintenance, or circumstances beyond its control.

The Service Provider is not liable for content posted by Users or for damages arising from use of the Platform in a manner contrary to these Terms of Service.

8. Termination and Account Deletion

The User may delete their Account at any time by contacting the Service Provider at support@libriya.app.

The Service Provider reserves the right to suspend or delete the Account of a User who violates these Terms of Service, after first requesting that the violations cease.

9. Changes to the Terms of Service

The Service Provider reserves the right to amend these Terms of Service. Users will be informed of any changes at least 14 days in advance by e-mail or via a notice on the Platform.

Continued use of the Platform after changes come into effect constitutes acceptance of those changes.

10. Final Provisions

These Terms of Service are governed by Polish law. Any disputes arising from the use of the Platform shall be resolved amicably, and failing that, before the competent common court.

Matters not covered by these Terms of Service are governed by the applicable provisions of Polish law.
